AbriStitch Terms of Use
Effective: 31.10.2026 · Version 1.0
Draft. A lawyer reviews this text before release; until then it is not the version in force.
These terms are an agreement between you and DREAM CAR, LTD LLC, 142-a, of. 11, vul. Shevchenka, Kharkiv 61013, Ukraine ("we", "us"), the publisher of the AbriStitch app. AbriStitch is an app of the Abris Art brand. By using the app you accept these terms. Our Privacy Policy explains how we handle personal data.
If you are a consumer, nothing in these terms limits the rights that the mandatory law of your country gives you.
1. The service
AbriStitch is a free cross-stitch tracker. It lets you open Abris Art kit patterns by QR code or code, import your own pattern files, mark your progress, sync it between your devices, and discuss a pattern with other users. There are no ads, purchases or subscriptions in the app.
We may improve, change or stop features. If we ever stop the online service, we will tell you in the app at least 60 days before; the progress and files on your phone stay usable.
2. Who may use it
You must be at least 13 years old. If you are under 16 (or the age of digital consent in your country), you need a parent's permission to post in discussions and to turn on the optional data-sharing switches.
3. Your account
The app creates an anonymous account automatically. You can link Apple, Google or email to it to restore your data on another phone. Keep access to your sign-in method; we cannot restore an anonymous account that was lost together with the phone. You can delete your account at any time in Settings → Account.
4. Abris Art patterns
Abris Art kit patterns in the app are licensed to you free of charge for personal, non-commercial use to stitch the pattern. You may not copy them out of the app, sell, publish or share them, or use them to make kits or products for sale. All rights in them stay with their owners. A QR code only opens a pattern; it does not sell or unlock anything.
5. Your content
Your files. You can import pattern files (for example PDF, OXS, XSD). Import only files you have the right to use, for example patterns you created, bought, or that their author made free. Your files are private: we never show them to other users and never sell them.
To provide the service you give us a non-exclusive, worldwide, royalty-free licence, to the extent of your rights in the file, to store, copy, convert and analyse your files in order to: show them in the app, keep your cloud and backup copies, restore them on your devices, and check and improve our importers. If a file does not import correctly and you send it to us (or allow automatic sending), the licence also covers keeping it in our importer test collection as described in the Privacy Policy. The licence ends when the file is deleted from our systems.
Your posts. Posts you write in a pattern's discussion are visible to other users who open the same pattern. You keep all rights in them. You give us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and distribute your posts within AbriStitch, to adapt their format for display, and to translate them automatically for other users. The licence lasts as long as the post is available in the app, plus up to 6 months in backups and for handling complaints. You can delete your posts at any time; posts cannot be edited.
You are responsible for what you post and upload, and you confirm that it does not infringe anyone's rights.
6. Rules for using AbriStitch
Do not:
- post or upload anything illegal, including content that infringes copyright, trademarks or other rights;
- share patterns or their files in discussions, post links to unauthorised copies, or ask for them;
- harass, threaten, insult or discriminate against anyone; post hate speech, sexual or violent content;
- post other people's personal data, or your own contact details for private dealing;
- post advertising, spam, or links (links are not allowed in discussions);
- impersonate others, including Abris Art staff;
- break, overload, probe or reverse-engineer our servers or bypass limits and security, or use the service with bots;
- use the app to train AI models or to build a competing pattern collection from other people's content.
Patterns and stitching are what discussions are for: tips, corrections, questions about a pattern, proposals.
7. Moderation and reports (EU Digital Services Act)
How we moderate. We review posts that are reported to us, and we may check others. An automatic word filter may block a post before it is published; it never deletes your account. Decisions to hide a post, remove a file, or restrict an account are taken by a person. We may: hide a post; remove a file from our servers; temporarily block posting; for serious or repeated violations, block posting permanently or close the account. We act in a proportionate way and take into account the rights of everyone involved, including freedom of expression.
Report content. Use "Report" on any post, or use the procedure at stitch.abrisart.com/copyright (for copyright and any other illegal content). We confirm receipt, decide without undue delay and tell the reporter the outcome.
If we act against your content you will see in the app what we did, why, and on what basis (a term of these terms or a law). You can ask us to review the decision by writing to [email protected] within 6 months; a different person reviews it and we reply with reasons. You may also use out-of-court dispute settlement bodies certified under the Digital Services Act, or the courts.
Repeat infringement. We block posting for accounts that repeatedly post clearly illegal content, after a warning. We may stop processing reports from people who repeatedly send clearly unfounded ones.
Block. You can block another user; you will not see their posts.
Contacts. Single point of contact for users and authorities (DSA Art. 11 and 12): [email protected], languages Ukrainian, English and Polish. Our legal representative in the EU (DSA Art. 13): to be announced.
8. Imports and accuracy
We try to import every pattern file correctly and show you a check after each import. Pattern files come in many formats and qualities, so an import can contain mistakes. Compare the colours and counts with your printed chart before you start, especially for expensive materials. Report any mistake: we fix the importer.
9. Availability and data safety
We design the app so that progress is never lost: it is saved on your phone first and synced when you are online. Still, keep your phone backed up. The service may be interrupted for maintenance or by events outside our control.
10. Liability
The app is free. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where the law does not allow a limitation. For slight negligence we are liable only for breach of an essential obligation (one that makes the service possible and on which you may rely), and then only for damage typical and foreseeable for a free service of this kind. Otherwise we are not liable for indirect loss or lost data that you could have avoided with a backup. Your statutory rights as a consumer in relation to digital content, including updates and conformity, remain unaffected.
11. Third-party services
Sign in with Apple and Google Sign-In are provided by Apple and Google under their own terms. The app stores' terms apply to the download. For apps downloaded from the App Store, the additional terms in section 15 apply.
12. Ending
You can stop using the app and delete your account at any time. We may suspend or end your access for serious or repeated breaches of these terms, with a statement of reasons; in other cases with 30 days' notice. Sections 5 (for the time stated there), 10 and 14 survive.
13. Changes to these terms
We may change these terms for good reasons (new features, changes in law, security). We will tell you in the app at least 30 days before a change that is not purely in your favour. If you do not agree, you can delete your account before the change applies.
14. Law and disputes
These terms are governed by the law of Ukraine. If you are a consumer living in another country, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts of that country. Please contact us first at [email protected]; we will try to solve the issue within 30 days.
15. Additional terms for the App Store
These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation for the app. Apple is not responsible for claims by you or third parties relating to the app (including product liability, failure to meet legal requirements, consumer protection, privacy, or intellectual property claims); we are responsible as described in these terms. You confirm that you are not in a country subject to a US government embargo and not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
